Rain event BMP inspection requirements in South Carolina

The 24-hour rain event inspection requirement is the part of the SCDHEC Construction General Permit that most often produces compliance violations on otherwise well-managed sites. The weekly seven-day clock is predictable and schedulable. The rain event trigger is not. It fires at any hour, activates at every active permitted site in the affected area simultaneously, and gives 24 hours from the end of the qualifying event.

What constitutes a qualifying rain event

The SCDHEC Construction General Permit requires a post-storm BMP inspection within 24 hours of any rainfall event of 0.5 inches or greater at the construction site. The threshold is measured at the site, not at the nearest weather station. On-site rain gauge readings are the most defensible documentation for determining whether the threshold was met. In the absence of an on-site gauge, the standard practice is to use the nearest NOAA-quality weather station, noting the station location and distance from the site in the inspection record.

The 24-hour clock runs from the end of the rain event, not from when the rain started. For an overnight storm that produces 0.8 inches between 10 PM and 4 AM, the clock runs from 4 AM and the inspection is due before 4 AM the following morning. The practical window for a morning inspection flight is the first usable daylight after the storm.

Rain event inspections do not reset the weekly clock

A rain event inspection satisfies the 24-hour requirement, nothing more. The seven-day clock continues running from the last routine inspection. A site inspected on Monday that receives a qualifying rain on Wednesday requires a rain event inspection by Thursday, and the next seven-day inspection is still due the following Monday. During active construction months in South Carolina, a single storm can convert a manageable inspection schedule into a week where both clocks are running simultaneously across a full site portfolio.

This is the situation that produces most rain event violations. An inspector who completes the rain event inspection correctly but treats it as the week's inspection misses the seven-day deadline. The inspection record shows the rain event inspection and then a gap. SCDHEC checks the gap.

What the rain event inspection must cover

A rain event inspection under the SCDHEC CGP is not an abbreviated check. It must cover the same BMP inventory as any other scheduled inspection: the full perimeter silt fence, every sediment basin and trap with pool level and outlet condition, inlet protection at each inlet, construction entrance, slope stabilization measures, and any areas of active erosion or discharge.

The inspection record must document current conditions, not pre-storm conditions. The purpose of a rain event inspection is to assess BMP performance after the storm, identify any failure or damage, and initiate corrective action. An inspection record that shows all BMPs functioning without noting changed conditions after a significant rain event raises credibility questions if SCDHEC compares it to post-storm aerial imagery or later inspections.

The multi-site problem

A storm that produces 0.5 inches across a large geographic area triggers simultaneous rain event obligations at every active permitted site within the rain footprint. For a CEPSCI inspector carrying eight to twelve active sites across multiple SC counties, a single overnight storm can require eight to twelve individual inspection records to be completed by the following morning.

Ground inspection of each site takes proportional time. A large 40-acre site with complex BMP networks takes two to three hours from arrival to departure. An inspector who cannot physically reach all sites within the 24-hour window on their own is in violation on every site not inspected in time, regardless of BMP condition on those sites.

Documentation logistics for rain event inspections

Rain event inspections that hold up under SCDHEC review have three things: the date and time the inspection was conducted (within 24 hours of the qualifying event), documentation of BMP conditions at that time, and a note on the precipitation that triggered the inspection, including the measured or estimated rainfall total and the source of that measurement.

GPS-tagged aerial documentation with flight timestamp is particularly useful for rain event inspections because the timestamp is embedded in the file metadata, not just the written record. A photo taken at 7:14 AM on the morning after a qualifying event documents the inspection time independent of the written log entry.
