SC H4679 and commercial drone operators: what changes in 2027

SC H4679 requires FAA Part 107 certification for commercial drone operations in South Carolina. The law takes effect January 1, 2027. For GCs, environmental consultants, and property owners who contract drone operators for construction documentation, BMP inspections, or site surveys, the practical requirement is: your vendor needs to be Part 107 certified.

H4679 creates a state-level enforcement mechanism for the FAA Part 107 commercial drone rule, which already applies federally. After January 1, 2027, operating a drone commercially in South Carolina without Part 107 certification is a violation of both state and federal rules.

Part 107 certification requires passing a written aeronautical knowledge test and holding a current Remote Pilot Certificate issued by the FAA. Certified operators are authorized to conduct commercial operations under the federal framework, with airspace approvals required for operations near airports or in controlled airspace.

Construction documentation, BMP inspection flights, site surveys, and commercial property inspections are all commercial drone operations under H4679. Contracting an uncertified operator for this work means the documentation is produced by someone operating outside federal and (after January 2027) state commercial drone rules.

For NPDES-permitted sites in South Carolina, the inspection record documents the inspection method. Using aerial documentation from an uncertified operator creates a documentation problem on top of the compliance concern. Verify Part 107 certification and ask for a certificate of insurance before signing any drone services contract.

Part 107 certification does not require the operator to carry liability insurance. For construction and inspection work, ask for a certificate of insurance as a standard part of the services agreement. A certified, insured operator is the baseline for any commercial drone work on a construction or commercial property site.

Until January 1, 2027, the state enforcement layer does not apply, but FAA Part 107 requirements are already in effect federally. Any commercial drone operator in South Carolina should already hold current Part 107 certification. The effective date does not change what is currently required under federal rules.
